A motion to dismiss an indictment against former Letcher County Sheriff Shawn Stines is being denied.
Stines is accused of shooting and killing District Judge Kevin Mullins in September 2024 in the judge’s chambers.
The defense had argued that prosecutors presented false and misleading testimony to a grand jury regarding Stines’ mental state.
A judge has ruled that prosecutors did not engage in misconduct during grand jury proceedings, allowing for the case to move forward.
